According to the conclusion, the work of reviewing, reducing, simplifying and decentralizing administrative procedures of the Ministry of Health is still slow, incomplete, and not in accordance with the Government’s Resolution and the Prime Minister’s direction. .
Through inspection of 20 administrative procedures and 5 documents adjusting management procedures of 5 units under the Ministry of Health (Department of Drug Administration, Department of Medical Examination and Treatment Management, Department of Food Safety, Department of Medical Administration traditional pharmaceuticals, Department of Infrastructure and Medical Equipment), Government Inspectorate discovered many inadequacies and violations.
Of these, there are 19 administrative procedures that are overdue, 10 administrative procedures that are overdue by over 50% and some administrative procedures that are overdue by 89-90%.
“Some administrative procedures have overdue documents averaging over 400 days. For some dossiers, the time for receiving and transferring dossiers for appraisal and requesting additional dossiers takes longer than 2-4 years, while the process is determined to be 3 years. working days”, the conclusion stated in the current situation.
The Government Inspectorate clearly stated: At the Vietnam Drug Administration, there is a situation where documents are submitted first, checked first but not resolved in advance according to the FIFO principle.
The Drug Administration of Vietnam has not fully announced the current status of document processing in the information system serving the management of the Ministry of Health’s management process.
Also according to the Government Inspectorate, monitoring and managing the process of document management and administrative procedures still has many limitations and weaknesses.
“The Drug Administration of Vietnam is lax in managing and monitoring the detailed list of documents serving the management of 3 administrative procedures including “Issue, extend, change, supplement drug circulation registration certificate”, “Complete drug section” that appeared before 2020 was resolved during the investigation period.
In the 5 units mentioned above, the Government Inspectorate believes that there is a situation where businesses have to supplement and complete documents outside of regulations, and the number of additional requests exceeds the prescribed number of times;
Since then, according to the inspector, the business had to expand and explain many times, causing difficulties for the business.
The results of a sample inspection of 20 administrative procedures show that the rate of overdue documents in the fields of pharmacy, traditional medicine and medical equipment is very high, with many years of backlog being one of the reasons leading to the situation. lack of medicine and equipment.
With limitations and weaknesses in document management and not fully implementing the FIFO principle in document management, the Government Inspectorate believes that there are risks of creating a ask-give-give mechanism, causing trouble. inconvenient in ensuring objectivity and fairness. transparency in the management of administrative procedures, causing frustration for people and businesses.
The Government Inspectorate requested the Ministry of Health to direct the Drug Administration of Vietnam to have solutions to drastically rectify and immediately overcome the situation of lax management and supervision of documents to resolve many management methods.
The Government Inspectorate also requested the Ministry of Health to rectify and improve public responsibility and overcome shortcomings in granting certificates of advertising content for health-protecting foods, drugs and medical examination and treatment services.
“Fully implement the appraisal process and strengthen inspection and examination, especially in cases of advertising health protection foods that are different from the registered content, easily causing misunderstandings about their uses, origin, quality, can affect people’s health, causing social waste,” the inspector asked.
The Government Inspector General requested the Ministry of Health to review legal regulations to prevent taking advantage of the conditions and procedures for registering health protection food products to register medicinal products (if any).
